Artikel 1 - Definities
In deze voorwaarden wordt verstaan onder:

1. Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht;

2. Consument: de natuurlijke persoon die niet handelt voor doeleinden die verband houden met zijn handels-, bedrijfs-, ambachts- of beroepsactiviteit;

3. Herroepingsrecht: de mogelijkheid van de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;

4. Ondernemer: de in artikel 2 genoemde onderneming;

Artikel 3 - Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod van STA Design en op elke tot stand gekomen overeenkomst op afstand tussen STA Design en consument.
Artikel 4 - Het aanbod

1. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.

2. Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten.

Artikel 5 - De overeenkomst

1. De overeenkomst komt, onder voorbehoud van het bepaalde in lid 4, tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden.

2. Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt STA Design onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod.

3. Indien STA Design aansprakelijk is voor schade bij de consument is STA Design nimmer aansprakelijk voor meer schade dan het factuurbedrag, dan wel de verzekering van STA Design ter zake van die schade uitkeert.

Artikel 6 - Herroepingsrecht

1. De consument kan een overeenkomst met betrekking tot de aankoop van een product gedurende een bedenktijd van 30 dagen zonder opgave van redenen ontbinden. STA Design mag de consument vragen naar de reden van herroeping, maar deze niet tot opgave van zijn reden(en) verplichten.

2. De in lid 1 genoemde bedenktijd gaat in op de dag nadat de consument, of een vooraf door de consument aangewezen derde, die niet de vervoerder is, het product heeft ontvangen, of:

   • a. als de consument in eenzelfde bestelling meerdere producten heeft besteld: de dag waarop de consument, of een door hem aangewezen derde, het laatste product heeft ontvangen. STA Design mag, mits hij de consument hier voorafgaand aan het bestelproces op duidelijke wijze over heeft geïnformeerd, een bestelling van meerdere producten met een verschillende levertijd weigeren.

   • b. als de levering van een product bestaat uit verschillende zendingen of onderdelen: de dag waarop de consument, of een door hem aangewezen derde, de laatste zending of het laatste onderdeel heeft ontvangen;

   • c. bij overeenkomsten voor regelmatige levering van producten gedurende een bepaalde periode: de dag waarop de consument, of een door hem aangewezen derde, het eerste product heeft ontvangen.

Artikel 7 - Verplichtingen van de consument tijdens de bedenktijd
Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. Hij zal het product slechts uitpakken of gebruiken in de mate die nodig is om de aard, de kenmerken en de werking van het product vast te stellen. Het uitgangspunt hierbij is dat de consument het product slechts mag hanteren en inspecteren zoals hij dat in een winkel zou mogen doen.

Artikel 8 - Uitoefening van het herroepingsrecht door de consument en kosten daarvan

1. Als de consument gebruik maakt van zijn herroepingsrecht, meldt hij dit binnen de bedenktermijn per email aan STA Design.

2. Zo snel mogelijk, maar binnen 30 dagen vanaf de dag volgend op de in lid 1 bedoelde melding, zendt de consument het product terug, of overhandigt hij dit aan (een gemachtigde van) STA Design. Dit hoeft niet als STA Design heeft aangeboden het product zelf af te halen. De consument heeft de terugzendtermijn in elk geval in acht genomen als hij het product terugzendt voordat de bedenktijd is verstreken.

3. De consument zendt het product terug met alle geleverde toebehoren, in originele staat en verpakking, en conform de door STA Design verstrekte redelijke en duidelijke instructies

4. Het risico en de bewijslast voor de juiste en tijdige uitoefening van het herroepingsrecht ligt bij de consument.

5. De consument draagt de administratiekosten van het terugzenden van het product a 6,95 euro per artikel.

6. De consument draagt de administratiekosten van het terugzenden van een rembourslevering a 18,35 euro & 1% van het aankoopbedrag per artikel.

Artikel 9 - Verplichtingen van STA Design bij herroeping

1. Als STA Design de melding van herroeping door de consument op elektronische wijze mogelijk maakt, stuurt hij na ontvangst van deze melding onverwijld een ontvangstbevestiging.

2. STA Design gebruikt voor terugbetaling hetzelfde betaalmiddel dat de consument heeft gebruikt, tenzij de consument instemt met een andere methode.

3. Als de consument heeft gekozen voor een duurdere methode van levering dan de goedkoopste standaardlevering, hoeft STA Design de bijkomende kosten voor de duurdere methode niet terug te betalen.

Artikel 10 - Uitsluiting herroepingsrecht
STA Design kan de navolgende producten en diensten uitsluiten van het herroepingsrecht, maar alleen als STA Design dit duidelijk bij het aanbod, althans tijdig voor het sluiten van de overeenkomst, heeft vermeld:

1. Volgens specificaties van de consument vervaardigde producten, die niet geprefabriceerd zijn en die worden vervaardigd op basis van een individuele keuze of beslissing van de consument, of die duidelijk voor een specifieke persoon bestemd zijn;

2. Producten die snel bederven of een beperkte houdbaarheid hebben;

3. Verzegelde producten die om redenen van gezondheidsbescherming of hygiëne niet geschikt zijn om te worden teruggezonden en waarvan de verzegeling na levering is verbroken;

4. Producten die na levering door hun aard onherroepelijk vermengd zijn met andere producten;

5. Producten die gebruikssporen hebben.

Artikel 11 - De prijs

1. Gedurende de in het aanbod vermelde geldigheidsduur worden de prijzen van de aangeboden producten en/of diensten niet verhoogd, behoudens prijswijzigingen als gevolg van veranderingen in btw-tarieven.

2. De in het aanbod van producten of diensten genoemde prijzen zijn inclusief btw.

Artikel 12 - Nakoming overeenkomst en extra garantie 
STA Design staat er voor in dat de producten en/of diensten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en/of bruikbaarheid en de op de datum van de totstandkoming van de overeenkomst bestaande wettelijke bepalingen en/of overheidsvoorschriften.

Artikel 13 - Levering en uitvoering

1. STA Design zal de grootst mogelijke zorgvuldigheid in acht nemen bij het in ontvangst nemen en bij de uitvoering van bestellingen van producten en bij de beoordeling van aanvragen tot verlening van diensten.

2. Als plaats van levering geldt het adres dat de consument aan STA Design kenbaar heeft gemaakt.

3. Met inachtneming van hetgeen hierover in artikel 4 van deze algemene voorwaarden is vermeld, zal STA Design geaccepteerde bestellingen met bekwame spoed doch uiterlijk binnen 30 dagen uitvoeren, tenzij een andere leveringstermijn is overeengekomen. Indien de bezorging vertraging ondervindt, of indien een bestelling niet dan wel slechts gedeeltelijk kan worden uitgevoerd, ontvangt de consument hiervan uiterlijk 30 dagen nadat hij de bestelling geplaatst heeft bericht.

4. Het risico van beschadiging en/of vermissing van producten berust bij STA Design tot het moment van verzending, tenzij uitdrukkelijk anders is overeengekomen.

Artikel 14 - Betaling
De consument heeft de plicht om onjuistheden in verstrekte of vermelde betaalgegevens onverwijld aan STA Design te melden.

Artikel 15 - Slotbepalingen

1. Aanvullende dan wel van deze algemene voorwaarden afwijkende bepalingen mogen niet ten nadele van de consument zijn en dienen schriftelijk te worden vastgelegd dan wel op zodanige wijze dat deze door de consument op een toegankelijke manier kunnen worden opgeslagen op een duurzame gegevensdrager.
    

2. Alle geschillen die voortvloeien uit een overeenkomst met een consument zullen worden beslecht door de bevoegde rechter te Amsterdam NL.

Consumer: the natural person who does not act for purposes related to his trade, business, craft or professional activity;

Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period;

Entrepreneur: the company referred to in Article 2;

Article 3 - Applicability

These general terms and conditions apply to every STA Design offer and to every distance contract that has been concluded between STA Design and the consumer.

Article 4 - The offer

If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

The offer contains a complete and accurate description of the products offered.

Article 5 - The contract

The agreement is, subject to the provisions of paragraph 4, concluded at the moment of acceptance by the consumer of the offer and the fulfillment of the corresponding conditions.

If the consumer has accepted the offer electronically, STA Design will immediately confirm electronically the receipt of the acceptance of the offer.

If STA Design is liable for damage to the consumer, STA Design will never be liable for more damage than the invoice amount, or the insurance of STA Design in respect of that damage.
 

Article 6 - Right of withdrawal

The consumer can terminate an agreement regarding the purchase of a product without giving any reason during a 30-day reflection period. STA Design may ask the consumer about the reason for withdrawal, but does not require them to state their reason (s).

The reflection period referred to in paragraph 1 starts on the day after the consumer, or a third party designated by the consumer in advance, who is not the carrier, has received the product, or:

a. if the consumer ordered several products in the same order: the day on which the consumer, or a third party designated by him, received the last product. STA Design may, provided it has informed the consumer in a clear manner prior to the ordering process, refuse an order for several products with a different delivery time.

b. if the delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by him, received the last shipment or the last part;

c. in contracts for regular delivery of products during a certain period: the day on which the consumer, or a third party designated by him, has received the first product.

Article 7 - Obligations of the consumer during the cooling-off period

During the reflection period, the consumer will handle the product and packaging carefully. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a store.

 

Article 8 - Exercise of the right of withdrawal by the consumer and costs thereof

If the consumer makes use of his right of withdrawal, he will notify STA Design by email within the cooling off period.

As soon as possible, but within 30 days from the day following the notification referred to in paragraph 1, the consumer returns the product, or hands it over to (an authorized representative of) STA Design. This is not necessary if STA Design has offered to collect the product itself. In any case, the consumer has complied with the return period if he returns the product before the cooling-off period has expired.

The consumer returns the product with all accessories, in original condition and packaging, and in accordance with the reasonable and clear instructions provided by STA Design.

The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.

The consumer bears the administration costs of returning the product a 6.95 euro per item.

The consumer bears the administration costs of returning a COD delivery a € 18.35 & 1% of the purchase price per item.
 

Article 9 - Obligations of STA Design on revocation

If STA Design makes the notification of withdrawal by the consumer electronically possible, it will immediately send an acknowledgment of receipt after receipt of this notification.

STA Design uses the same payment method that the consumer has used for reimbursement, unless the consumer agrees to another method.

If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, STA Design does not have to repay the additional costs for the more expensive method.

Article 10 - Exclusion of right of withdrawal

STA Design can exclude the following products and services from the right of withdrawal, but only if STA Design has clearly stated this in the offer, at least in time for the conclusion of the agreement:

Products manufactured according to the consumer's specifications which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer or which are clearly intended for a specific person;

Products that spoil quickly or have a limited shelf life;

Sealed products which for reasons of health protection or hygiene are not suitable to be returned and of which the seal has been broken after delivery;

Products that are irrevocably mixed with other products by their nature after delivery;

Products that have traces of use.

Article 11 - The price

During the period mentioned in the offer, the prices of the offered products and / or services will not be increased, except for price changes due to changes in VAT rates.

The prices mentioned in the offer of products or services include VAT.

Article 12 - Compliance agreement and additional warranty

STA Design guarantees that the products and / or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and / or usability and the legal provisions existing on the date of the conclusion of the agreement. / or government regulations.

Article 13 - Delivery and execution

STA Design will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services.

The place of delivery is the address that the consumer has made known to STA Design.

With due observance of what is stated in article 4 of these general terms and conditions, STA Design will execute accepted orders expeditiously but no later than 30 days, unless another delivery period has been agreed. If the delivery is delayed, or if an order can not or only partially be executed, the consumer will receive notification of this no later than 30 days after he has placed the order.

The risk of damage and / or loss of products rests with STA Design until the moment of shipment, unless expressly agreed otherwise.

Article 14 - Payment

The consumer has the duty to report inaccuracies in provided or stated payment details to STA Design without delay.

 

Article 15 - Final provisions

Additional provisions or deviating from these terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

 

All disputes arising from an agreement with a consumer will be settled by the competent court in Amsterdam in the Netherlands
